Spouse / De Facto Spouse

As the husband, wife or de facto partner of an Australian citizen or permanent resident you may apply for a residency visa for Australia

If you are applying on de facto grounds you must have been living with your spouse for 12 months immediately before your application, unless an exemption applies.

Prospective Marriage

As the prospective spouse (fiancé) of an Australian citizen or permanent resident, intending to marry in Australia this is the visa category to apply for.

Prospective spouses must have personally met their spouse.  You will receive a temporary visa to stay in Australia for up to nine months.  You must marry your sponsor in Australia and then apply for a temporary visa once the marriage has taken place.  You will be granted a two year provisional (temporary) visa if you meet the requirements, and if your relationship is ongoing at the end of two years you will be granted a permanent visa.

Interdependent Partner

As an interdependent partner (same sex partner) of an Australian citizen, permanent resident, or eligible New Zealand citizen you may be eligible for migration under this category.

The relationship must have existed for 12 months immediately before application (unless exempted), must be ongoing and involve a mutual commitment to a shared life.

Each case under this migration category is assessed on it’s own merits and will be determined by the documentation submitted with your application.  Whilst most of the visas issued will initially be temporary residency visas (with permanent residency being granted two years later providing the relationship is ongoing), there are same cases under which permanent residency will immediately be granted.
