Business Migration - Provisional Categories The aim of the Business Skills category is to attract applicants to Australia who have a demonstrated record of business or investment activity and who are committed to using these skills to enhance the Australian economy by developing links with international markets; facilitating the creation and maintenance of employment in Australia; exporting Australian goods and services; manufacturing goods or providing services in Australia which would otherwise need to be imported; introducing new technology; and increasing commercial activity and competitiveness.
The majority of business skills entrants will initially enter Australia on a 4 year provisional visa (with the exception of applicants for the Business Talent subclass 132 visa). As holders of a provisional visa and having successfully operated a business, or maintained their investment, in Australia for two to four years, applicants are then able to apply for permanent residency. The following is an overview of the various temporary business skills sub classes, all of which have their own specific requirements. This list is not exhaustive and we suggest you give us a call to find out what other options may be available to you, and how you would eventually obtain permanent residency in Australia.

Business Owners (Provisional) (subclasses 160 and 163) Open to owners or part-owners of a business in which the applicant (and spouse together) have had net assets in a qualifying business of not less than A$200,000 in two of the last four fiscal years (no net asset requirement if sponsored by an Australian State or Territory government business development agency under subclass 163 – except where the specific sponsor has a requirement). In addition to meeting the net assets requirement, the applicant is also required to show that the main business(es) had a turnover of at least A$500,000 in two of the last four fiscal years (or A$300,000 if sponsored by an Australian State or Territory government business development agency under subclass 163 – except where the specific sponsor has a different requirement). Senior Executives (Provisional) (subclasses 161 and 164) Open to senior executives employed in the top three levels of management of a major business in two of the last four years, and who have been responsible for strategic policy development affecting a wide range (or major component of its business). Applicant (and spouse together) must have net personal and business assets of not less than A$800,000 (A$500,000 if sponsored by an Australian State or Territory government business development agency 164 – except where the specific sponsor has a requirement) available for transfer to Australia within a two year period, plus sufficient assets available to settle in Australia. As with the business owner category there are other criteria to be met including, but not limited to:

Investment Linked (Provisional) (subclass 162 and 165) Open to owners or part-owners of an eligible investment(s) or qualifying business(es) who have a record of successful business and / or investment activities and who are able to deposit a minimum of A$1,500,000 (A$750,000 if sponsored by an Australian State or Territory government business development agency – except where the specific sponsor has a requirement) for four years in a designated fixed term government security in Australia. In addition to this applicants (and spouse together) are required to show that in two of the last four fiscal years they have net assets to the value of at least A$2,250,000 (A$1,125,000 if sponsored by an Australian State or Territory government business development agency – except where the specific sponsor has a requirement.
